Abstrak

To play its role as the guardian of the constitution, the Constitution Justice also faces some obstacles. The pros and cons following the decision it made occur quite often, more over if the decision has been waited by public. One of the controversial decisions is the ordeal on Act No.30 of 2002 revealing that the version regulating the formation of Tipikor (Anti-Corruption) Court is against UUD 1945.

Therefore, the constitution finally appears as a “guide” or a norm giving the information about the right and obligation to the peoples of a country in their function as either common people or as a government. For that reason, the formation and the changes on a constitution require the people participation so that their needs will be accommodated within the constitution.

Abstrak

The change on Act. No. 32 of 2004 on Local Government which especially regulates Local Election results in some implications. One of the implications is an obvious shift for Head of Region; from local election to general election. This shift has also implication in terms of solving a problem from Supreme Court Justice to Constitution Justice. Although the shit of regime strengthens the role of the Supreme Court Justice in solving any dispute of General Election, it also causes many problems requiring some strategic steps.
